As the traffic levels on our roads increase year on year, it is not surprising that more and more road works are needed to keep them up to a good standard.
Contractors are obliged by law to deploy sufficient signage and traffic control equipment to ensure that road users can negotiate the works safely. Fortunately for us many major road works are carried out at night, particularly on motorways to help minimise disruption to traffic.
Avoiding accidents at road works
The best way to avoid having an accident when traversing any kind of road works is to slow down. When approaching road works there will usually be signage indicating some kind of speed restriction, sometimes with temporary 'average speed' cameras to ensure that the limits are obeyed. These restrictions are often frustrating for the driver but are absolutely necessary to ensure a safe, steady flow of traffic through the obstruction, so don't ignore them.
If you have an accident when passing through road works
If you feel that your accident was in some way caused by poorly laid out or implemented traffic control system around the road works, you might have trouble proving it. Road works are usually planned months or years in advance, and their associated traffic control systems are given a lot of thought. If you have an accident whilst traversing road works the chances are it will be the fault of yourself or the driver of another vehicle
.
If you want to make a claim
If you feel that you have good reason to suspect that the traffic control system or contractors are in some way to blame for the accident, then you can make a claim in the same way as you would for any non-fault accident.
Collect as much information as possible at the scene of the accident in order to support your claim. Such information might include photographs, contact details of anyone else involved - including witnesses, copies of police reports, registration numbers etc.
The more information you have to support your claim, the better your chances of it being successful.
