No win no fee accident claims solicitors seem to be everywhere these days - but what does it actually mean? No win no fee compensation claims were introduced in the UK in 1995. They were created to help ease the pressure on the government run legal aid system and give the less well off better access to legal representation.
Previously legal aid was the only way someone with limited financial means could hope to pursue a legal case, and there were many criteria that had to be met in order to qualify. As the 'pot' of money made available by the government for legal aid gets smaller and smaller every year, it can only mean that access to these funds is going to get more difficult.
A No Win No Fee arrangement or Conditional Fee Arrangement (CFA) ensures that if you do not win your accident claim, you do not have to pay your solicitor a fee. If you lose, your insurance will cover you against the other party's costs and expenses. If you win your no win no fee claim you should receive your compensation without any deductions because your solicitor's fees should be paid by the other party's insurer.
The advantage of No Win No Fee arrangements as opposed to legal aid is that it not only saves tax payers money, but it means that the decision as to whether your case is taken on is down to your chosen solicitor and not based on complex qualifying criteria imposed by an independent regulator.
This system differs from the American system in that they follow a ‘contingency fee arrangement’, which awards the successful lawyer with a percentage of their clients compensation award.
